NO. 12,166

 

The following Ordinance was introduced by Mr.  Harvey  who moved for its adoption and was seconded by Mr.  Marshall:

AN ORDINANCE DECLARING CERTAIN IMMOVABLE PROPERTY IN MONROE LOCATED AT 3901 JACKSON STREET AS NO LONGER BEING NEEDED FOR PUBLIC USE AND AUTHORIZING THE SAME TO BE SOLD TO HP INVESTMENTS, LLC, PURSUANT TO LOUISIANA REVISED STATUTE 33:4712 AND FURTHER PROVIDING WITH RESPECT THERETO: 

WHEREAS, HP Investments LLC would like to purchase a certain 2.3 acre tract of land, which is part of a larger 18.92 acre tract, located within the City of Monroe with a municipal address of 3901 Jackson Street;

WHEREAS, the City of Monroe does not have any plans for the use or development of the property, the property is not currently needed for any public purpose, and the City does not believe that the property will be needed for a future public purpose;

 WHEREAS the proposed purchase price of this 2.3 acre tract of land is $50,000.00 which is fair market value, per the attached appraisal; and

WHEREAS, the City of Monroe deems said proposal to be in the best interest of the City of Monroe.

THEREFORE, BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that the City Council does hereby declare that certain 2.3 acre tract located in the City of Monroe and more particularly described in the proposed Cash Deed, is no longer needed for public use.

BE IT FURTHER ORDAINED that Mayor Friday Ellis be and is hereby authorized and empowered, on behalf of the City of Monroe, Louisiana, to sell, for cash, to HP INVESTMENTS, LLC the 2.3 acre tract of land under the terms, conditions and for the consideration set forth in the attached Cash Deed.

BE IT FURTHER ORDAINED that Mayor Friday Ellis be and is hereby authorized and empowered to execute the sale documents for and on behalf of the City of Monroe, Louisiana.

BE IT FURTHER ORDAINED that under the provisions of Louisiana Revised Statute 33:4712 that prior to the final adoption hereof, notice of this Ordinance shall be published in the official journal three (3) times within fifteen (15) days, one week apart and that any opposition hereto must be made in writing, filed with the Clerk of the Council within fifteen (15) days of the first publication.

NOTICE PUBLISHED on the  28th  day of  April 2023 and May 5th & 12th, 2023.

This Ordinance having been submitted in writing, introduced and published, was then submitted to a vote as a whole, the vote thereon being as follows:

AYES: Harvey, Woods & Marshall

NAYS: None.

ABSENT: Ezernack & Dawson

And the Ordinance was declared ADOPTED on the  23rd   day of  May 2023.
