The following Ordinance was offered by Ezernack who moved for its adoption and was seconded by Harvey:

AN ORDINANCE TO AMEND THE ZONING MAP FOR THE CITY OF MONROE, LOUISIANA AND PROVIDING FURTHER WITH RESPECT THERETO:

WHEREAS, the City Council of the City of Monroe has held its Public Hearing with respect to the following proposed Zoning Map Amendment, to-wit:

An amendment to the Zoning Map to zone a ±12-acre tract of land, from being located in Ouachita Parish to the I-1, (Industrial Business Park) District, in order for the applicant to have a commercial truck stop, retail sales and restaurant facilities, at 355 HWY 594.

355 HWY 594 (23.867-acres more or less)

A 23.867 ACRE TRACT SITUATED IN SECTION 8, T 17 N, R 5 E

OUACHITA PARISH, LOUISIANA

A certain piece, parcel or lot of ground, together with all improvements thereon, rights, ways and privileges therein to belonging or in any way appertaining, being, lying and situated in Section 8, Township 17 North, Range 5 East, Ouachita Parish, Louisiana, being more particularly described as follows, to wit:

Beginning at a 1/” diameter iron rod (found) marking the intersection of the western right-of-way line of Russell Sage Road with the north right-of-way line of U. S. Interstate 20, said point bearing the state plane coordinate, northing of 724,949.0401 and east of 3,437,844.2710, north American datum of 1983, Louisiana North Zone (1701), US Survey feet, said point also marking the POINT OF BEGINNING of the tract to be described;

Thence proceed south 25 degrees 43 minutes 33 seconds west, a grid bearing, departing said western right-of-way line and along said north right-of-way line, a distance of 72.77 feet to a ½” diameter iron rod (found);

Thence turn right and proceed in a southwesterly direction, along said northern right-of-way line, a distance of 70.92 feet along the arc of a curve concave to the north, having a radius of 110.00 feet and a chord that bears south 61 degrees 59 minutes 52 seconds west, a chord distance of 69.70 feet to a ½” diameter iron rod (found);

Thence turn right and proceed south 80 degrees 28 minutes 02 seconds west, along said northern right-of-way line, a distance of 99.63 feet to a ½” diameter iron rod (found);

Thence turn left and proceed in a southwesterly direction, along said northern right-of-way line, a distance of 325.59 feet along the arc of curve concave to the south, having a radius of 455.00 feet and a chord that bears south 59 degrees 58 minutes 02 seconds west, a chord distance of 316.69 feet to a ½” diameter iron rod (found);

Thence turn left and proceed south 39 degrees 28 minutes 02 seconds west, along said north right-of-way line, a distance of 340.24 feet to a ½” diameter iron rod (found);

Thence turn right and proceed in a southwesterly direction, along said northern right-of-way line, a distance of 333.04 feet along the arc of a curve concave to the northwest, having a radius of 650.00 feet and a chord that bears south 54 degrees 08 minutes 45 seconds west a, a chord distance of 329.41 feet to a 5/8” diameter iron rod (set);

Thence turn right and proceed north 02 degrees 04 minutes 03 seconds east, departing said northern right-of-way line, a distance of 1,554.30 feet to a 5/8” diameter iron rod (set);

Thence turn right and proceed south 87 degrees 55 minutes 55 seconds west, a distance of 605.00 feet to a 5/8” diameter iron rod (set);

Thence turn right and proceed south 02 degrees 04 minutes 05 seconds west, a distance of 110.00 feet to a 5/8” diameter iron rod (set);

Thence turn left and proceed south 87 degrees 55 minutes 50 seconds east, a distance of 343.59 feet to the western right-of-way line of Russell Sage Road, said point being marked by a 5/8” diameter iron rod (set);

Thence turn right and proceed in a southwesterly direction, along said western right-of-way line, a distance of 205.92 feet along the arc of a curve concave to the west, having a radius of 5,674.58 feet and a chord that bears south 00 degrees 59 minutes 54 seconds west, a chord a distance of 206.90 feet to a ½” diameter iron rod (found);

Thence turn right and proceed south 05 degrees 26 minutes 02 seconds west, along said western right-of-way line, a distance of 136.13 feet to the POINT OF BEGINNING.

The above-described tract contains 23.867 acres, (1,039,646 square feet), more or less, and is more particularly indicated on ALTA/NSPS Land Title Survey by Pan American Engineers, LLC, Job No. 11328, Drawing No. 13292.

Note:  The surveyed tract as indicated hereon is a portion of the same property as referred to in Exhibit “A” of the commitment for title insurance by Chicago Title Insurance Company, File No.: 190251, effective date: November 19, 2019 Bearing and distance discrepancies between this survey and record surveys are a result of found monuments in the field and different datums, I.E. assumed bearing versus state plane grid bearings.  This legal description was prepared in conjunction with this survey and is intended to update the legal description of record.

APPLICANT: Love’s Travel Stop (MA 107-22)

WHEREAS, the City Council has further considered the report of the Monroe Planning Commission recommending approval, on a 4-0-1 majority vote. The applicant wishes to utilize an existing building for a commercial truck stop, retail sales and restaurant facilities. The I-1 (Industrial Business Park) District is the appropriate zoning district for these uses.

NOW, THEREFORE:

BE IT ORDAINED by the City Council of the City of Monroe, Louisiana in legal session convened that the Zoning Map of the City of Monroe and the boundaries thereof which map is described in Section 37-34 of the City of Monroe Comprehensive Zoning Ordinance and which map shown the Zoning Districts and Boundaries thereof, be and the same are hereby amended to rezone the ±12-acres described to I-1 (Industrial Business Park) District as shown on the map which is attached hereto and made a part thereof and which is adopted as the new Zoning Map of the City of Monroe.

This ordinance was INTRODUCED on the 26th day of July 2022.

NOTICE PUBLISHED on the  1st, 3rd & 5th day of  August, 2022.

This Ordinance having been submitted in writing, introduced and published was then submitted to a final vote as a whole, the vote thereon being as follows:

AYES: Harvey, Ezernack, Marshall & Dawson

NAYS: None.

ABSENT: Councilwoman Woods

And the Ordinance was declared ADOPTED on the 9th day of August, 2022.
