NO. 12,134

The following Ordinance was offered by Harvey who moved for its adoption and was seconded by Marshall:

AN ORDINANCE DECLARING CERTAIN IMMOVABLE PROPERTY IN MONROE, LA, IDENTIFIED AS PARCEL 76532 BY THE OUACHITA PARISH TAX ASSESSOR AND, IDENTIFIED BY DEPARTMENT OF TRANSPORTATION AND DEVELOPMENT (DOTD) OF LOUISIANA, STATE PROJECT NO. H.007300 AS PARCELS 22-1, 22-1-C-1 AND 22-3 AS NO LONGER BEING NEEDED FOR PUBLIC USE AND NECESSARY FOR DOTD PROJECT NO. H.007300, AND AUTHORIZING THE SAME TO BE SOLD TO THE DOTD PURSUANT TO LOUISIANA REVISED STATUTE 33:4712, AND FURTHER PROVIDING WITH RESPECT THERETO

WHEREAS, Department Of Transportation and Development of the State of Louisiana STATE PROJECT NO. H.007300 – KANSAS LANE – GARRETT ROAD CONNECTOR AND I-20 IMPROVEMENTS, Routes: LA 594, I-20, Garrett Road, & Kansas Lane, Ouachita Parish, is in need of a certain piece of immovable property owned by the City of Monroe and identified by the Ouachita Parish Tax Assessor Parcel 76532 and by DOTD of LA as Parcel 22-1, 22-1-C and 22-3, and more fully described in the attached documents, and

WHEREAS, the proposed purchase price for the property needed for DOTD of Louisiana State Project No. H.007300, F.A.P. No:H007300 – Kansas Lane – Garrett Road Connector and I-20 Improvements  Routes: LA 594, I-20, Garrett Road, & Kansas Lane, Ouachita Parish is $176,597.00; a copy of the compensation letter is attached hereto and made a part hereof, and

WHEREAS, the City of Monroe deems said proposal to be necessary and in the best interest of the City of Monroe.

THEREFORE, BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that the City Council does hereby declare that certain parcel of immovable property identified by the Ouachita Parish Tax Assessor as Parcel 76532, Monroe, LA and more particularly described on the plats and Right of Way Maps, a copy of which is attached hereto and made a part hereof, as being no longer needed for public use.

BE IT FURTHER ORDAINED that Friday Ellis, Mayor, be and is hereby authorized and empowered, on behalf of the City of Monroe, Louisiana, to sell, for cash, to Department of Transportation and Development of the State of Louisiana, the above-mentioned immovable property under the terms, conditions and for the consideration set forth in the said sale documents attached hereto.

BE IT FURTHER ORDAINED that Friday Ellis, Mayor, be and he is hereby authorized and empowered to execute the said sale documents for and on behalf of the City of Monroe, Louisiana.

BE IT FURTHER ORDAINED that under the provisions of Louisiana Revised Statute 33:4712 that prior to the final adoption hereof, notice of this Ordinance shall be published in the official journal three (3) times within fifteen (15) days, one week apart and that any opposition hereto must be made in writing, filed with the Clerk of the Council within fifteen (15) days of the first publication.

NOTICE PUBLISHED on  July 1st, 8th, 15th & 29th, 2022.

This Ordinance having been submitted in writing, introduced, and published, was then submitted to a vote as a whole, the vote thereon being as follows:

AYES: Harvey, Ezernack, Marshall & Dawson

NAYS: None.

ABSENT: Councilwoman Woods

And the Ordinance was declared ADOPTED on the  9th day of  August, 2022.
