CITY OF MONROE
NO. 12,108

The following Ordinance was introduced by Harvey who moved for its adoption and was seconded by Exernack:

AN ORDINANCE AUTHORIZING THE CITY OF MONROE TO ENTER INTO A PIPELINE AND ABOVEGROUND FACILITIES SERVITUDE AND EASEMENT BETWEEN THE CITY OF MONROE AND ATMOS ENERGY CORPORATION, AND FURTHER PROVIDING WITH RESPECT THERETO

WHEREAS, the City of Monroe desires to enter into the attached Pipeline and Aboveground Facilities Servitude and Easement with Atmos Energy Corporation  (“Atmos”) related to the properties outlined in the attached agreement and more specifically identified in the attached agreement and plat for the purposes of Atmos laying, constructing, operating, maintaining, inspecting, repairing, replacing, changing the size of, relocating, changing the route or routes of, abandoning in place and removing at will, in whole or in part, aboveground and underground pipeline or pipelines and the appurtenances thereto, including, without limitation, valves, fittings, metering facilities, pigging facilities, pressure regulating facilities, cathodic protection equipment, communications facilities, barricades and fencing, the right to construct and install gravel, asphalt or concrete upon the surface of the said easement area, and aerial markers and other appurtenances as may be necessary or convenient in the operation of said facilities;

WHEREAS, the property described hereinafter in this Ordinance is needed and necessary for said project and is not needed by the City for a public purpose; and

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Monroe, Louisiana in legal session convened, that an authorized City representative be, and he is hereby authorized and empowered for and on behalf of the City of Monroe to enter into the Pipeline and Aboveground Facilities Servitude and Easement attached hereto and made a part hereof.

ORDINANCE INTRODUCED on the  22nd day of  March, 2022.

NOTICE PUBLISHED on the  25th day of  March, 2022.

This Ordinance having been submitted in writing, introduced and published, was then submitted to a vote as a whole, the vote thereon being as follows:

AYES: Harvey, Ezernack, Woods, Marshall & Dawson

NAYS: None.

ABSENT: None.

And the Ordinance was declared ADOPTED on the 12th day of  March, 2022.
