NO. 12,098

The following Ordinance was introduced by Ezernack who moved for its adoption and was seconded by Harvey:

AN ORDINANCE DECLARING CERTAIN IMMOVABLE PROPERTY IN THE MONROE AIR INDUSTRIAL PARK AS NOT BEING NEEDED FOR PUBLIC USE AND AUTHORIZING THE SAME TO BE SOLD AT PRIVATE SALE TO THE CHENNAULT AVIATION & MILITARY MUSEUM PURSUANT TO REVISED STATUTE 33:4712, AND FURTHER PROVIDING WITH RESPECT THERETO

WHEREAS, the Chennault Aviation & Military Museum has requested that the City of Monroe sell to the Chennault Aviation & Military Museum a certain 2.46-acre tract of land located within the Monroe Air Industrial Park with an address of (No Situs) Carrier Drive, and

WHEREAS, the Chennault Aviation & Military Museum would like to purchase the 2.46 acre tract for future expansion of the museum, and

WHEREAS, the property to be sold to the Chennault Aviation & Military Museum is currently vacant, and

WHEREAS, the proposed purchase price of this 2.46 acre tract of land is $55,500.00, said price being the appraised value of the property as per an appraisal dated 6/21/21, by Appraisal Consultants, LLC, a copy of which is attached hereto and made a part hereof, and the cost of the appraisal;

WHEREAS, the City of Monroe deems said proposal to be in the best interest of the City of Monroe.

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that the City Council does hereby declare that certain 2.46- acre tract of land located in Monroe Air Industrial Park in the City of Monroe, Louisiana and more particularly described in the proposed Cash Deed, a copy of which is attached hereto and made a part hereof, as not needed for public use.

BE IT FURTHER ORDAINED that Friday Ellis, Mayor, be and he is hereby authorized and empowered, on behalf of the City of Monroe, Louisiana, to sell, for cash, at private sale, to CHENNAULT AVIATION & MILITARY MUSEUM, the 2.46-acre tract of land under the terms, conditions and for the consideration set forth in the said Cash Deed.

BE IT FURTHER ORDAINED that Friday Ellis, Mayor, be and is hereby authorized and empowered to execute the said Cash Deed for and on behalf of the City of Monroe, Louisiana.

BE IT FURTHER ORDAINED that the proposed sale approved herein be and it is hereby conditioned upon approval and consent by the FAA as required by the Act of Conveyance from the United States of America to the City of Monroe which transferred ownership of said property to the City of Monroe.

BE IT FURTHER ORDAINED that the proceeds of said sale be dedicated to and used for the operation, maintenance and development of the Monroe Regional Airport in accordance with the above-mentioned Act of Conveyance.

BE IT FURTHER ORDAINED that under the provisions of Louisiana Revised Statute 33:4712 that prior to the final adoption hereof, notice of this Ordinance shall be published in the official journal three (3) times within fifteen (15) days, one week apart and that any opposition hereto must be made in writing, filed with the Clerk of the Council within fifteen (15) days of the first publication.

NOTICE PUBLISHED on the  3rd, 10th, & 17th day of  January, 2022.

This Ordinance having been submitted in writing, introduced and published, was then submitted to a vote as a whole, the vote thereon being as follows:

AYES: Harvey, Ezernack, Woods, Marshall & Dawson

NAYS: None.

ABSENT: None.

And the Ordinance was declared ADOPTED on the  24th day of  January, 2022.
