NO. 12,077

The following Ordinance was introduced by Harvey who moved for its adoption and was seconded by Dawson:

AN ORDINANCE DECLARING CERTAIN IMMOVABLE PROPERTY IN MONROE LOCATED AT 412 BREARD AND (NO SITUS) NORTH 4TH STREET AS NO LONGER BEING NEEDED FOR PUBLIC USE AND AUTHORIZING THE SAME TO BE SOLD TO CHILL HOLDINGS LLC PURSUANT TO LOUISIANA REVISED STATUTE 33:4712, AND FURTHER PROVIDING WITH RESPECT THERETO

WHEREAS, Chill Holdings LLC would like to purchase a certain piece of immovable property located 412 Breard St. and (no situs) N 4th St., Monroe, LA, and more fully described in the attached copy of the proposed Cash Deed document, and

WHEREAS, the proposed purchase price for the property on 412 Breard St. and (no situs) N 4th St. is $70,605.00.  This price consists of the fair market value of $70,000 plus the cost of the appraisal, $500.00, by Appraisal Consultants, LLC, dated 6/21/21, a copy of the Summary of Just compensation is attached hereto for review, and the cost of filing and recording; and

WHEREAS, the City of Monroe deems said proposal to be in the best interest of the City of Monroe.

THEREFORE, BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that the City Council does hereby declare that certain parcel of immovable property located 412 Breard St. and (no situs) N. 4th St., Monroe, LA and more particularly described in the proposed sale document, a copy of which is attached hereto and made a part hereof, as being no longer needed for public use.

BE IT FURTHER ORDAINED that Friday Ellis, Mayor, be and is hereby authorized and empowered, on behalf of the City of Monroe, Louisiana, to sell, for cash, to CHILL HOLDINGS LLC represented herein Chandler C. Hill, President of Chill Holdings LLC, the above-mentioned immovable property under the terms, conditions and for the consideration set forth in the said sale documents attached hereto.

BE IT FURTHER ORDAINED that Friday Ellis, Mayor, be and he is hereby authorized and empowered to execute the said sale documents for and on behalf of the City of Monroe, Louisiana.

BE IT FURTHER ORDAINED that under the provisions of Louisiana Revised Statute 33:4712 that prior to the final adoption hereof, notice of this Ordinance shall be published in the official journal three (3) times within fifteen (15) days, one week apart and that any opposition hereto must be made in writing, filed with the Clerk of the Council within fifteen (15) days of the first publication.

NOTICE PUBLISHED on the  30th  day of  July, 2021 and August  6th & 13th , 2021.

This Ordinance having been submitted in writing, introduced, and published, was then submitted to a vote as a whole, the vote thereon being as follows:

AYES: Harvey, Ezernack, Woods, Marshall & Dawson

NAYS: None.

ABSENT: None.

And the Ordinance was declared ADOPTED on the  24th day of  August, 2021.
