The following Ordinance was offered by Mrs. Ezernack who moved for its adoption and was seconded by Ms. Woods :
Amendment to Chapter 37, Zoning, of the Code of the City of Monroe, Article III, Use Districts, Section 37-37 Commercial Use Districts, Table 3.3 Commercial Districts Permitted, Conditional Uses, in the Use Standards to add in the table referring to the restaurant, full-service
WHEREAS, the City Council of the City of Monroe has this date held its Public Hearing with respect to the following proposed amendments to Chapter 37, Zoning, of the Code of the City of Monroe, Article III, Use Districts, Section 37-37 Commercial Use Districts, Table 3.3 Commercial Districts Permitted, Conditional Uses, in the Use Standards to add in the table referring to the restaurant, full-service; and
WHEREAS, the addition of “a Conditional Use Permit may be needed for alcohol sales, depending on the Zoning Classification” to help alleviate confusion as to what is allowed and;
WHEREAS, the requirements in this section pertain to and clarify whether alcohol sales is permitted within the business zones. Clarification within definition shall only offer alcoholic beverages for on-premises consumption, unless otherwise noted for a full-service restaurant. These instances will coincide within the B-2, B-3, CBD or B-4 zones;

WHEREAS, the City Council has further considered the recommendation of the Monroe Planning Commission recommending approval, on a 4-0-1 vote, and that the above stated Sections of the Code of the City of Monroe should be amended.
NOW, THEREFORE;
BE IT ORDAINED, by the City Council of the City of Monroe, Louisiana, in legal session convened, that Chapter 37, Zoning, of the Zoning Ordinance of the City of Monroe, Louisiana be, and it is amended as follows:
Add:

Article VI Use Supplementary Use Standards
Section 37-92
(l) Restaurants -Full-Service Restaurants may need to obtain a Conditional Use Permit depending on what zoning classification it is located in.

Article II Definitions
Section 37-21
Restaurants, Full-service – A restaurant with table service (order placement and delivery on-site) provided to patrons, also including cafeterias; carry out service, if any, shall be a limited portion of the facility and activity. Full-service restaurants shall only offer alcoholic beverages for on-premises consumption. (A Conditional Use Permit may be needed for alcohol sales depending on the Zoning Classification.)
