 EMERGENCY ORDINANCE

 

STATE OF LOUISIANA

 

CITY OF MONROE                                                                                                         NO.  12,078               

 

            The following Ordinance was introduced by Mr.  Harvey                        who moved for its adoption and was seconded by Mrs.  Ezernack                  :

 

AN ORDINANCE DECLARING THE CONDITION OF THE STORM SEWER ON BROADMOOR BLVD. AND MAGELLAN ST. TO BE AN EMERGENCY NECESSITATING IMMEDIATE REPAIRS AND FURTHER PROVIDING WITH RESPECT THERETO.

 

 

            WHEREAS, there have recently been repairs to the underground storm sewer pipe and cave-ins at various locations on Magellan St and Broadmoor Ave; and

 

            WHEREAS, the repairs have not been effective due to groundwater pressure and the degraded condition of the pipe; and

 

            WHEREAS, the condition is unstable and continues to deteriorate as recently observed following a major rain event when the number and size of the cave-ins increased; and

 

            WHEREAS, an engineering inspection was made on August 20, 2021 which deemed the condition an immediate threat of damage adjacent property and a hazard to the public in need of stabilization and repairs as an emergency; and

 

WHEREAS, due to conditions of the existing pipes soil is being washed into the storm water system causing subsidence and undermining which is an imminent danger to nearby structures including streets, driveways and residences such that the pipes requires immediate stabilization and repair to stop the subsidence and undermining; and

 

            WHEREAS, the City has already begun the process of mobilizing a contractor to make further investigation and such repairs as necessary to stabilize the condition and repair the subsidence and undermining which have occurred and are continuing by injecting grout to repair the damage to the pipe; and

 

            WHEREAS, upon further investigation and evaluation other conditions may be identified which require immediate stabilization and repair to prevent further subsidence and undermining and risk of imminent danger to adjacent properties; and

 

WHEREAS, funds are available through the street fund.

 

            NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that the condition of the underground storm sewer pipe and cave-ins at various locations on Magellan St and Broadmoor Blvd poses a danger to the public and is hereby declared an emergency.

 

            BE IT FURTHER ORDAINED that such investigation, evaluation and emergency repairs necessary to stabilize and repair the condition are authorized and Friday Ellis,  Mayor of the City of Monroe or his designee is authorized to enter into such contracts as may be necessary to complete the project.

 

            This Ordinance having been submitted in writing and was then submitted to a vote as a whole, the vote thereon being as follows:

 

 

            AYES:            Harvey, Ezernack, Woods, Marshall & Dawson

 

            NAYS:            None.

 

            ABSENT:      None.

 

            And the Ordinance was declared ADOPTED on the  24th    day of  August   ,

2021.
