The following Ordinance was offered by Mr. Echols who moved for its adoption and was seconded by Mrs. Ezernack :
AN ORDINANCE ADOPTING AND AMENDING THE ZONING MAP FOR THE CITY OF MONROE, LOUISIANA

WHEREAS, the City Council of the City of Monroe has held its Public Hearing with respect to the following proposed Zoning Map Amendment, to-wit:
An amendment to the Zoning Map to create Century Village Planned Unit Development, Phase 1C, a ±12.088 acre tract of land, presently located in Ouachita Parish and more particularly described as follows:
Lots C1-C51, of the proposed Century Village Planned Unit Development, Phase 1C.
APPLICANT: Southern Lifestyle Development (PUD 104-19)
WHEREAS, the City Council has further considered the report of the Monroe Planning Commission recommending approval, on a 4-0-1 vote. A Planned Unit Development (PUD) is a residential, commercial, or mixed-use development guided by a total design plan in which one or more of the zoning or subdivision regulations, other than use regulations, shall be permitted to be waived or varied to allow flexibility and creativity in site and building design and location. The PUD is a hybrid of a zoning amendment and a subdivision, therefore, an ordinance is required to change the zoning map.
The Century Village Planned Unit Development will be a mixed use development including a variety of residential types, commercial and public spaces. Phase 1C will include single-residential development and a park area. This review is the Final Plat Review for Phase 1C. Variations include the building setback lines, lot size and widths, and Lots C46-C51 will not front upon a dedicated public street.
The applicant has requested that Hyde Place be removed from this phase. Lots C46 – C51 were to front upon Hyde Place. Instead the lots will front upon a park/common area. The Comprehensive Subdivision Ordinance states that “Except where permitted by the Planning Commission and City Council in accordance with a Planned Unit Development, or as provided by these regulations, no lot shall be laid out so that it does not have access to, and frontage on, a dedicated public street according to the requirements of these regulations.” An alley, as defined by the Comprehensive Zoning Ordinance, states “a dedicated right-of-way twenty (20’) feet or less in width, that affords only a secondary means of access to property abutting thereon.”
The access servitude will provide access to these lots. They WILL NOT front on a public right-of-way. The access servitude will be across private property. There is a separate Servitude Agreement between the City of Monroe and Century Village Development Company, LLC regarding the Access Servitude in lieu of a traditional public Right-of-Way.
Right-of-way: The term used to describe the publicly owned improved or unimproved areas between property lines. This area is dedicated for use by the public for pedestrian and vehicular travel, and may include elements such as streets, curbs, gutters, sidewalks, street furniture, bus stops, utility poles, landscaping and signage.
All common areas and sidewalks will be owned and maintained by the Homeowner’s Association,

The B-3, General Business/Commercial District will remain the underlying zoning district but is being varied as part of this Planned Unit Development.
One of the requirements of a Planned Unit Residential Development is to have 30% of the development reserved for open space/recreational areas and this development meets that requirement. The maintenance and care of all the common areas shall be the responsibility of Southern Lifestyle Development, LLC or a property owners association formed for this purpose.
NOW, THEREFORE
BE IT ORDAINED by the City Council of the City of Monroe, Louisiana in legal session convened that the Zoning Map of the City of Monroe and the boundaries thereof which map is described in Section 37-34 of the City of Monroe Comprehensive Zoning Ordinance and which map shown the Zoning Districts and Boundaries thereof, Century Village Planned Unit Development, Phase 1C, consisting of Lots C1-C51, is shown on the map which is attached hereto and made a part thereof and which is adopted as the new Zoning Map of the City of Monroe.
This ordinance was INTRODUCED on the 22nd day of October 2019.
NOTICE PUBLISHED on the 25th, 28th & 30th day of October , 2019.
This Ordinance having been submitted in writing, introduced and published was then submitted to a final vote, the vote thereon being as follows:
AYES: Echols, Ezernack, Woods & Clark
NAYS: None.
ABSENT: Wilson
And the Ordinance was declared ADOPTED on the 12th day of November , 2019.
