NO. 12,022
The following Ordinance was offered by Ms. Woods who moved for its adoption and was seconded by Mrs. Ezernack :
AN ORDINANCE ESTABLISHING A TWELVE (12) MONTH MORATORIUM UPON THE RECEIPT AND PROCESSING OF ALL APPLICATIONS FOR CERTIFICATES OF OCCUPANCY, BUILDING PERMITS AND ANY OTHER LAND USE DEVELOPMENT APPROVALS ASSOCIATED WITH USED TIRE STORES; AND FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, the City finds it necessary to impose an immediate moratorium on the receipt and processing of all applications for Certificates of Occupancy, Building Permits and any other land use development approvals associated with used tire stores until penalties are addressed under the violations section in Article IX Administration and Enforcement; and
WHEREAS, the City has approved an ordinance to regulate used tire stores due to the increased number of this use and as a result the number of complaints regarding nuisance and environmental issues has proliferated; and
WHEREAS, the City is concerned with the rapid expansion of this type of use and the strong potential it has to create nuisance, environmental and fire issues; and
WHEREAS, the City is having a difficult time enforcing this Ordinance due to Environmental Court not having authority to find anyone guilty of a misdemeanor nor impose criminal fines and due to the length of time for City Court to adjudicate the matter;
NOW, THEREFORE;
BE IT ORDAINED, by the City of Monroe, Louisiana, has the authority to adopt a moratorium for the purpose of preserving the status quo while standards, criteria, procedures, etc. are considered prepared and enacted.
BE IT FURTHER ORDAINED, that the City hereby imposes a moratorium upon the receipt and processing of all applications for Certificates of Occupancy, Building Permits and any other land use approval associated with used tire stores for twelve (12) months from the effective date of this Ordinance until the City’s Comprehensive Zoning Ordinance reviewed and amended as necessary.
This ordinance was INTRODUCED on the 13th day of October, 2020.

This Ordinance having been submitted in writing, introduced and published was then submitted to a final vote, the vote thereon being as follows:
AYES: Harvey, Ezernack, Woods, Marshall & Dawson
NAYS: None.
ABSENT: None.
And the Ordinance was declared ADOPTED on the 27th day of October , 2020.
