CITY OF MONROE

NO. 12,165

The following Ordinance was offered by Mr.  Harvey  who moved for its adoption and was seconded by Mr.  Marshall:

AN ORDINANCE DECLARING CERTAIN MOVABLE PROPERTY OF THE CITY OF MONROE AS BEING NO LONGER NEEDED FOR PUBLIC USE AND AUTHORIZING HENDERSON AUCTIONS TO PROCEED WITH THE SALE OF THE SAID MOVABLE PROPERTY AND FURTHER PROVIDING WITH RESPECT THERETO.

WHEREAS, the City of Monroe (“City”) has determined that certain movable property of the City, a complete list and description of said property being attached hereto, is no longer needed for public purpose and is surplus property;

WHEREAS, on January 23, 2023, the Monroe City Council authorized Henderson Auctions to conduct the online public auction of the City’s movable property (see Resolution No. 8434).

WHEREAS, the City desires to hold and conduct a public auction of this property in an effort to realize the highest benefit to the City for this surplus movable property;

WHEREAS, this declaration that these properties are no longer needed for public purposes is required by La. R.S. 33:4712 and the authorization for public auction is authorized by La. R.S. 49:125.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, does hereby declare that the miscellaneous equipment, scrap, junk and other materials, listed in the attached Auction List, are no longer needed for public use and Mayor Friday Ellis is hereby authorized to sell at an online public auction for cash, after notice, any and all of said material at the best price on an “as is” basis, pursuant to Louisiana Revised Statutes 33:4712.

BE IT FURTHER ORDAINED, that under the provisions of Louisiana Revised Statutes 33:4712 that prior to final adoption herein, notice of this Ordinance will be published in the official journal three times within fifteen days, one week apart.  Any opposition must be filed with the Clerk of the Monroe City Council within fifteen days of the first publication.

ORDINANCE INTRODUCED on the  25th day of  April 2023.

NOTICE PUBLISHED on the  28th  day of  April 2023 and May 5th & 12th, 2023.

This Ordinance having been submitted in writing, introduced and published, was then submitted to a vote as a whole, the vote thereon being as follows:

AYES: Harvey, Woods & Marshall

NAYS: None.

ABSENT: Ezernack & Dawson

And the Ordinance was declared ADOPTED on the  23rd   day of  May 2023.
